Purpose and legal basis of data processing

We guarantee: We store your data only for the purposes of processing your personal inquiries and requests, the execution of contracts (including payment processing and possibly credit checks), as well as for our own advertising purposes. The processing is carried out on the basis of the EU General Data Protection Regulation.

In case you have a question, you want an offer or you want to sign a contract with us (for sale, rent, production, online orders, online customer account), either in the e-shop of MUNAKAVA (https://emagazinche.com) or in a specialized center of MUNAKAVA, we process your personal data. Depending on the type of contract, this personal data can be:

  • Name, surname
  • In case of legal entity - Name of the legal entity
  • Postal address
  • Email address (see "Tracking Shipments" below)
  • Phone / fax / mobile number
  • UIC / Tax number when issuing invoices;
  • IP address
  • Bank data of clients

This data is stored and processed by us in the customer data management center of MUNAKAVA in connection with the implementation and processing of the contract, as well as for our own advertising purposes. At least your name, surname and address are required for the conclusion of a contract in order for you to be identified. When purchasing through the online store, it is necessary to additionally indicate your e-mail address, and to confirm your order and its delivery - and your delivery address. When issuing invoices to legal entities, it is necessary to provide a company name, UIC and tax number by the legal entity. Without this data, it is not possible to fulfill the relevant contracts.

The IP address is used only if this is necessary to protect the legitimate interests of the controller or a third party, provided that the interests or fundamental rights and freedoms of the data subject that require the protection of personal data do not take precedence (e.g. bringing legal actions or investigating criminal offenses).

The employees of the MUNAKAVA Shopping Center, the Emagazinche e-shop and the MUNAKAVA Customer Service Center have access to the data in the MUNAKAVA customer data management center. The management of customer data by MUNAKAVA is based on the protection of the legitimate interests of the company MUNAKAVA and facilitates compliance with data protection rules for accuracy and portability of data. At the same time, we take sufficient account of your interests and fundamental freedoms, as through the provided customer service on the territory of Bulgaria we provide an opportunity for:

  • exchange of goods, if the contract provides for the right of exchange;

Processing of payments in the online store of MUNAKAVA

Data about your bank account and your payments (credit card data, bank transfer) are not collected, processed or stored in the electronic systems of MUNAKAVA. Payment processing is carried out only in electronic systems and under the technical and legal responsibility of our payment service providers.

We currently use the following payment service providers to process credit card and transfer payments:

We only use payment service providers that are PCI DSS * certified and accordingly meet the most stringent requirements for secure processing and storage of credit card data.

We store your data for as long as is necessary for the respective purpose:

  • Lease agreements: 6 years
  • Registration on the site: until the explicit refusal
  • Orders without registration: 6 years
  • Sales contracts: 6 years
  • Construction contracts: 6 years

Insofar as for certain data, which are processed for the purposes of the management of the sales contracts, a storage period is provided under the tax legislation (data from accounting documents), the storage period is 6, resp. 10 years. During this period, data processing is limited. The storage period runs from the end of the calendar year in which the offer was submitted, resp. the contract has been performed.

Rights of data subjects

You can withdraw your consent to the processing of your personal data at any time with effect for the future. Please note that you may need to resubmit your data before making a new purchase. This also applies in case you object to the further use of the data from your customer account in the MUNAKAVA e-shop.

Right to object

You have the right at any time and for reasons arising from your specific situation, to object to the processing of your personal data, which is carried out under the following conditions:

Art. (1) (e) the processing is necessary for the performance of a task in the public interest or in the exercise of official powers conferred on the controller, or

Art. 6 (1) (f) the processing is necessary for the purposes of the legitimate interests of the controller or of a third party, except where such interests take precedence over the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.

In the event that you object, we will terminate the processing of your personal data, unless we prove that there are compelling legal grounds for the processing that take precedence over your interests, rights and freedoms, or that the processing serves to establish, exercise or protect legal claims. This also applies to profiling carried out on the basis of these provisions.

  • You have the following rights with respect to the administrator in connection with the storage of your personal data:

Right to change

You have the right to receive from the administrator without undue delay the correction of inaccurate personal data, and you should notify him of the change in a timely manner.

 

Right to be deleted (right to be forgotten)
You have the right to delete your personal data relating to you without undue delay and we undertake to delete your personal data without undue delay when one of the following reasons exists:

Personal data are no longer needed for the purposes for which they were collected or processed.
Upon your withdrawal of the consent on which the processing is based in accordance with Article 6 (1) (a) of the ORD or Article 9 (2) (a) of the ORD and where there is no other legal basis for the processing.
 

Right to limit processing
Each data subject has the right to require the controller to restrict processing when one of the following conditions applies:

the accuracy of the personal data is disputed by the data subject for a period that allows the controller to verify the accuracy of the personal data.
the processing is illegal and the data subject does not want the personal data to be deleted, but instead wants to restrict their use.
the controller no longer needs the personal data for the purposes of processing, but they are required by the data subject to establish, exercise or defend legal claims.
the data subject has objected to the processing pursuant to Article 21 (1) of the DPA until it has been verified that the controller's legal grounds exceed those of the data subject.
 

Right to data portability
If one of the above conditions is met and the data subject requests a restriction on the processing of personal data stored by MUNAKAVA EOOD, he or she may at any time contact the controller.
You have the right to receive your personal data, which has been provided to the administrator, in a structured, frequently used and machine-readable format. You have the right to transfer this data to another controller without hindrance by the current controller to whom the personal data have been provided, provided that the processing is based on the consent of Article 6 (1) (a) of the ORD or Article 9 (2) (2). (a) by the DPA or a contract pursuant to Article 6 (1) (b) of the DPA and the processing is carried out in an automated manner, insofar as the processing is not necessary for a task performed in the public interest or in the exercise of public authority by the controller. Also, in exercising your right to data portability under Article 20 (1) of the DPA, you have the right to provide personal data directly from one controller to another where this is technically feasible and does not affect the rights and freedoms of others.

Right to object
You have the right to object at any time on grounds relating to the processing of your personal data, subject to point (e) or (f) of Article 6 (1) of the DPA. This also applies to profiling based on these provisions.

If MUNAKAVA Ltd. processes personal data for the purposes of direct marketing, you have the right to object at any time to the processing of personal data relating to you. This applies to profiling insofar as it relates to such direct marketing. If the data subject objects to MUNAKAVA EOOD for the direct marketing processing, MUNAKAVA EOOD will not process the personal data for these purposes.

Automated individual decision making, including profiling
Every data subject has the right, granted by the European legislator, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects which affect him or similarly significantly affect him, since the decision (1) is not necessary for the conclusion or performance of a contract between the data subject and the data controller, or (2) is not permitted by Union or Member State law to which the controller is subject and which also provides for appropriate rights protection measures. and the data subject's freedoms and legitimate interests; or (3) is not based on the data subject's express consent.

Right to withdraw consent for data processing
You have the right to withdraw your consent to the processing of your personal data at any time by contacting the contact details provided by the data protection officer or coordinator.
